The terms and conditions put below (the “Terms”) compose the entire understanding and deals between Mega Expeditions and the customer according to any and all bookings, trips or transactions made with Mega Expeditions. When the words “Mega Expeditions” “we” and
“us” are used in this file include owners, directors, officers, employees, representatives, agents and affiliates of Mega Expeditions, and the words “Customer, client, I and you” are used to refer to the clients of Mega Expeditions.
To do a reservation the client must to supply his personal information
• Full name, as in your current Passport.
• Passport number, nationality, age, sex.
• Confirm if you are an Adult or Student, Students apply only under 24 years old “with ISIC Card”.
• Confirm trip and departure date.
• Inform us about meals restrictions “vegetarian, vegan, or any allergies,”
• Inform us about medical problems, we have a lot of outdoor activities located in the high Andes mountains, it means low atmospheric pressure and high altitude, no recommended for people with heart and respiratory problems.
To begin your reservation a down payment is required by person, see Paragraph (5), Cancellation by Customer. You can make a pre-pay by (paid by credit card, pay online,or pre-pay by western union.
You can do it a down payment, this first payment will be done in the reservation moment, we recommend you to book your tour in advance, with many months if you are planning to add the huaynapicchu or machupicchu mountain and with more tan 6-months in advance, if you are planning to book the Inka Trail Classic.
You can do the down payment directly through the WebSite https://www.megaexpeditions.com/ using our payment platform WeTravel. With this platform you can use any credit card with an extra fee of 2.99%,
even if you have a bank account in the USA you can do it with your account number without extra fees, also, the first payment can be done through Western Union transaction to the owner data, Name: Nixon Andrés Álvarez Barrera ID: 002393485, in this transaction the client assume the fees.
The remaining amount will be paid in cash by you “the client” to Mega Expeditions once you arrive in Cusco, no extra fees if you do it in cash, however, if you do it with any credit card the fees is the 5% for foreigners and 20% for Peruvians.
All accommodations (hotels, boats, tents, etc.) are based on double occupancy. We will try to find roommates for single travelers willing to share accommodations. If this is not feasible or if you prefer single accommodations,
you will be assessed the Single Supplement charge listed for the itinerary. For hostels normally is $10USD for a private room but it changes depending on the location and town, and also the kind of accommodations for example private tent, car, hotel, etc.
If you must cancel, all reservation deposits will be returned minus a cancellation fee and Price tickets. Cancellations must be in writing through email.
If you made it with 91 or more days prior to departure Mega Expeditions refund you the 100% transferred less the Price of the special additionals if you had added it, those special additionals are listed below at the end of this section.
If you made it with 31- 90 days prior to departure, the penalty is the 10% of the total amount of the tour, so Mega expeditions refund you the total transferred less the 10% of the total Price of the tour and less the special additionals.
If you made it with 30 days and 25 hours prior to departure, the penalty is the 20% of the total amount of the tour, so Mega Expeditions refund you the total transferred less the 20% of the total Price of the tour and less the special additionals.
If you made it with 24 hours prior to departure or the same tour day, the penalty is the 100% of the total amount of the tour, so Mega Expeditions does not refund you anything.
IMPORTANT: No partial refunds will be given for unused hotel rooms, meals, sightseeing trips or trekking arrangements for any reason whatsoever. The Trip Cost is quoted as a package, it is not compounded by a broken-down price, and credits are not given for services not used.
Mega Expeditions reserves the right to cancel any trip due to insufficient sign-up (not meeting the 2- person minimum), which makes the trip economically unfeasible to operate. If this happens, a full refund of the
Trip Cost is given. However, Mega Expeditions is not responsible for additional expenses incurred by travelers pre-paying for the trip (i.e., non-refundable “Advance Purchase” flight tickets, equipment, medical expenses, hotels, etc.).
As we publish our prices in advance, Mega Expeditions may occasionally be faced with significant cost increases due to factors over which we have no control. Consequently, we reserve the right to charge the Customer a surcharge due to unfavorable exchange rates, increases in
airfares or other transport costs, taxes, or if government action should require us to do so. Surcharges will be calculated according to the full extra cost, compared to the original costs and exchange rates. Likewise, if our costs decrease, we will pass on the savings to the Customer.
Mega Expeditions is not responsible for any event or failure to act of any airline. We may use airlines different than the ones mentioned in our website announcements, and Mega Expeditions is not able to guarantee the type of aircraft to be used by any airline. In addition, Mega Expeditions is not responsible for losses due to cancelled flights,
or changed flight itineraries or seat assignment. The Customer may not cancel the contract without penalty due to a change of airline, aircraft type, route, or destination. The responsibility of the airlines is limited to the carriage of passengers and baggage in accordance with the airline’s terms and conditions of service.
Any costs, whether direct or incidental, incurred by the Customer as the result of delays caused by bad weather, trail conditions, river levels, road conditions,
mechanical failure, transportation delays, sickness, government intervention or other contingencies which are beyond the control of Mega Expeditions will not be reimbursed.
Fair changes in the itinerary may be made when consider advisable by Mega Expeditions for the comfort and well-being of the Customers because of unexpected circumstances or because of circumstances out of control of Mega Expeditions. The Customer will be informed of the change at the time of booking. If the change is made thereafter, Mega Expeditions will tell the Customer as soon as is reasonably possible.
Cancellations by the Customer made as a result of any such change shall be subject to the provisions of Paragraph 5, above.
Mega Expeditions shall not be liable for any damages arising from or related to any such change and the Customer waives the right to assert a claim for such damages against Mega Expeditions
Any changes made by the Customer with 91 or more days prior to departure can be done without any charges.
Any change between 90 and 15 days before departure will be charged a $30 USD per person, it includes administrative fee and penalty goverment to change tickets.
Any changes made between 15 days and 24 hours prior to departure will be charged a $50 USD per person.
Just for the Inka Trail tours no matter when
the customer does the change the penalty is always $100USD and depends on the availability to rebook the permits, other ways the reservation Will be lost without refunds.
No changes could be made by the Customer with less than 24 hours prior to departure. This includes, without limitation, booking additional accommodations, transfers or excursions. Mega Expeditions is not responsible for additional expenses incurred by the Customer as a result of such changes.
The Customer must at all times comply with the laws and respect the social norms of the country being visited as well as with all government regulations pertaining to customs, drugs and foreign exchange. At all times the decision of Mega Expeditions tour leader, tour guide, or representative is final on all matters that may threaten the safety, or interfere with the wellbeing,
of the group or individual Customers. if the Customer fails to abide this section, or if you “the customer” interfere with the wellbeing of the group or individual Customers, disrespecting, and attacking them, verbally or physically, Mega Expeditions tour leader, tour guide, or representative may order you to leave the tour without recourse to any refund.
It is necessary that the Customers with medical issues, inform us about those at the registration time. The tour guide has the right to disqualify anyone at any time during the trip if the trip leader believes that the Customer’s continued participation will jeopardize the health or wellbeing of the Customer involved or the group. Refunds are not given under such circumstances.
In the event a Customer is injured or becomes ill, Mega expeditions will attempt to secure the best possible medical attention available, offering the first aid. However, Mega Expeditions assumes no liability for or regarding the provision of medical care or its cost, and Mega Expeditions does not offer any insurance, the client is required to purchase health insurance.
Mega Expeditions assumes no liability for loss or damage to baggage in transit to
and from a Mega Expeditions trip or while on a Mega Expeditions trip.
Mega Expeditions highly recommends that the Customer purchase health insurance, including baggage and cancellation insurance.
• Travel Insurance is a cost-effective way to protect yourself and your equipment in the event of problems due to – Canceled Trips, Delays, Medical Problems, Baggage Loss or Damage.
• Travel insurance may be purchased through traditional insurers or online insurers (such as www.travelguard.com).
The Client must obtain and possess a valid passport (THE PASSPORT SHOULD BE VALID AT LEAST 185 DAYS FROM THE DEPARTURE DATE), all visas, permits, certificates, and vaccination certificates, required for the entire journey. The Client accepts responsibility for obtaining these documents and any other necessary documents. The information or advice provided by Mega Expeditions on visas, vaccinations, weather, clothing, luggage, special equipment, etc., is provided in good faith but without liability
by Mega Expeditions and the Client expressly waives any claim that Mega Expeditions is responsible for damages derived from said information or advice, it is the duty of the client to find what documents are required to travel. Once you arrive in Peru, we need you to send us a picture of your Passport and another picture of the Peruvian immigration stamp to finish the billing and pay taxes.
If a Customer has a claim or complaint against Mega Expeditions, the Customer must first inform Mega Expeditions of the claim or complaint in writing within five days after the end of the trip
or during the trip. Failure to comply with this requirement waives the Customer’s right to assert any such claim or complaint against Mega Expeditions.
I agree that any dispute concerning, relating, or referring to this contract, the catalogue, the website, or any other literature
or materials concerning my Mega Expeditions trip, or the trip itself shall be resolved exclusively by a Peruvian intermediary Institution.
The Client accepts that the only solution for any breach by Mega Expeditions that arises during the tour according to the Terms will be the partial refund of the Cost of the trip paid, that amount will be evaluated only by the sum of the values of those services not offered or not offered correctly,
the collateral damages generated are not taken into account. To the maximum extent permitted by applicable law, Mega Expeditions shall not be liable for any indirect, special, accidental or consequential damages of any kind (including personal injury) regardless of the form of the action, whether in hiring, in the tour execution (including negligence).
In the event that one or more of the terms, for any reason, is held to be invalid or unenforceable in any respect, such invalidity or unenforceability shall not affect any other term
or condition of this file, and the Terms shall be construed as if such invalid or unenforceable term would have never been contained herein.
The Terms may not be amended, altered or modified, except by a written amendment executed by the Customer and Mega Expeditions.
It is the intent of the Customer and Mega Expeditions that no part of the Terms be construed against any party because of the identity of the drafter.
All clients must purchase personal travel-related health insurance on their own. The insurance must cover personal accidents, medical expenses, air ambulance, death, repatriation costs and all other expenses that may arise as a result of a death,
damage or injury that occurs to the Client. Customers agree that it is their duty to obtain and/or verify that he has sufficient travel-related personal health insurance coverage for the trip.
I, “the Client”, acknowledge that I have voluntarily requested to make the trip mentioned in the reservation, and that I have read the description of the trip as it appears
in the itinerary of the website. I also declare that I am aware of the dangers involved in this kind of outdoor activities in the Andeans Mountains.
Mega Expeditions does not own or operate any entity that provides goods or services for your trip, including hotels, accommodation facilities, airlines, boats, buses, transportation companies, local transport operators, providers or organizers of optional excursions, service providers, food or entertainment. Mega Expeditions notifies that it acts independently and is not responsible for the service of third parties involved in the development of the tours and assumes no responsibility for expenses, injuries, or failures that occur during the provision of the service of an external company. Neither is it responsible for natural phenomena, detention, delays, quarantines, strikes, robberies, thefts, failure of any transport or equipment that is used by external providers, changes in the restrictions of national parks, modifications of the hotel, animals, marine life or vegetation of any kind, incidents during recreational activities such as diving, snorkeling, swimming, kayaking, sailing, canoeing, rafting, hiking, cycling, rock climbing, etc.,
sanitation problems, food poisoning, lack of access or quality medical care, difficulty evacuating in the event of a medical or other emergency, or for any other cause beyond the direct control of Mega Expeditions. The Client voluntarily participates in the trip with the knowledge that traveling to foreign countries and/or remote areas with different conditions and cultures brings unforeseen and unthinkable situations. The Client acknowledges that the enjoyment and excitement of adventure travel derives in part from the risks inherent in the tour beyond the accepted safety of life at home or work and that these inherent risks contribute to such enjoyment and excitement and are a reason for voluntary customer participation. I, the “client”, hereby agree to the above and are responsible for my own well-being, and accept each and every risk of delay, unanticipated events, illness, injury, emotional trauma, or death.
I acknowledge that the cost of all Mega Expeditions trips is very good, because the price was based on the Clients accepting this Release of liability and acceptance of all risks. Therefore, as a legal consideration for allowing me to participate in such adventure travel activities, I hereby ALWAYS RELEASE AND DISCLAIM MEGA EXPEDITIONS
FROM ANY LIABILITY FOR ANY EVENT ARISING DURING MY PARTICIPATION IN THE TRIP. I agree that this release will be legally binding on me, all minors under the age of 18 traveling with me, all members traveling with me. it being my intention to fully assume all risks associated with this trip.
PARENT OR GUARDIAN OF A MINOR – I, as the parent or guardian of the minor or minors traveling with me, give my permission for my child or ward to participate in the trip and I accept, personally and on behalf of my child or ward, the Conditions.
